In the following text, “the Artist” refers to Rigel Stuhmiller and “Client” refers to the purchaser of the custom artwork. Purchasing custom artwork from Rigel Stuhmiller indicates understanding and acceptance of the following terms:
1) DESCRIPTION OF WORK: By purchasing handmade artwork from the Artist, you are agreeing that the product you receive may differ slightly in color and/or alignment from the product depicted on your monitor, due to the handmade, hand-printed nature of each item and the variations in the way each monitor displays color.
Bu purchasing custom artwork from the Artist, you are agreeing that she will use her artistic interpretation to create a portrait based on a photo that you provide. You are agreeing that the finished portrait will be a result of her interpretation and therefore may not look exactly like your pet. Furthermore, you are agreeing that the final colors of the printed cards may vary from the mockup emailed to you, due to variations of computer monitors and the inherent nature of hand-mixed and hand-applied inks. Please refer to the images on the “before and after” page of this document for examples of what type of finished artwork can be expected from photos.
2) RESERVATION OF RIGHTS: All rights are reserved by the Artist, including but not limited to all rights in sketches, comps, or other preliminary materials.
3) REPRODUCTION RIGHTS: The Artist reserves all reproduction rights to the artwork. The artwork may not be reproduced in any manner without the express, written consent of the Artist. All approved reproductions shall bear the following copyright notice: © (year of purchase) by Rigel Stuhmiller. The Artist reserves all rights to market and resell images made from the sketch or plates created for each custom pet portrait or custom notecard.
4) PERMISSIONS AND RELEASES: The Client shall indemnify and hold harmless the Artist against any and all claims, costs, and expenses, including attorney’s fees, due to materials included in the work at the request of the Client for which no copyright permission or privacy release was requested or uses that exceed the uses allowed pursuant to a permission or release.
TERMS OF RETURN/ SATISFACTION GUARANTEE
We offer a 100% satisfaction guarantee with all of our products, including custom orders. If you are not happy with your order, you may return it in its original packaging within 2 weeks of its arrival at your address. You must email the artist directly at rigel@stuhmillerportraits.com in order to receive the complete instructions for your return. Custom and collection items may be returned for a refund or store credit. Shipping fees will not be refunded.
Before you order, please make sure to look at the before/after images in the informative PDF document and make sure that you are happy with the artist’s rendition of the portraits from the provided photos. With some variation, you can expect your portrait to be similar in style and faithful to the examples shown.
Because each portrait is Rigel’s artistic interpretation of your photo, you should expect some variation between your photo and the finished portrait. Due to the variations of computer monitors as well as variations in hand-mixed inks, please consider the background swatch color a suggestion and not an exact match. You are ordering a 100% hand-made product whose variations ae part of the charm.
While we offer this guarantee on all of our products, we do request that only serious customers place orders. We hope that you will respect the time involved in this labor-intensive process.
